The Workplace Relations Commission dismissed Olumide Smith’s Equal Status claim against An Post over a damaged envelope, finding it not well founded. The decision was dated 31 August 2022. Smith alleged that An Post discriminated against and harassed him on racial grounds after delivering a damaged, ripped envelope. An Post said the envelope may have been damaged in transit because it was too light for its contents, and denied deliberate damage, tampering or discrimination. The adjudicator found that An Post provided a service to the public, but Smith had not identified any of the nine discrimination grounds required for an Equal Status claim. The decision dismissed the claim under section 22 of the Equal Status Act, which allows claims considered frivolous or vexatious to be dismissed.
