A WRC adjudicator awarded a healthcare assistant €10,000 after finding she was unfairly dismissed by a hospital. The decision was dated 12 December 2022.
The assistant resigned in 2019, saying the hospital’s final written warning left her unable to return to work. The hospital denied constructive dismissal. It had first dismissed her over a patient-care incident, but an appeal replaced the dismissal with a final written warning.
The adjudicator found no basis for dismissal or another significant sanction. He said the warning breached mutual trust and confidence, and that she was entitled to consider herself dismissed. He awarded €10,000 compensation.
