The Workplace Relations Commission (WRC) awarded delivery driver Anthony O'Reilly €14,000 after finding his dismissal unfair. The decision, dated 20 April 2023, said Shannon Transport & Warehouse Company T/A STL Logistics had not shown that dismissing him was fair.

O'Reilly had worked for the company for about 20 years. It dismissed him over deliveries to Dublin's Bridge Tavern on 11 January and 7 March 2019, which it said were unscheduled and undocumented. O'Reilly said the deliveries were part of long-standing swaps between pubs.

The adjudication officer found the employer's decision was outside the range of reasonable responses and that the deliveries did not amount to gross misconduct. He said the company had not included swaps or undocumented deliveries in its procedures as conduct that could lead to summary dismissal. The officer also considered O'Reilly's length of service and found dismissal disproportionate.

A separate Payment of Wages complaint was withdrawn at the hearing.
