A Workplace Relations Commission adjudication officer found Mark Bissett was unfairly dismissed and ordered Shannon Transport & Warehouse Company T/A STL Logistics to pay him €2,320 in compensation. The decision was dated 20 April 2023.
Bissett, a helper with 20 years’ service, was dismissed over four unscheduled deliveries to Dublin’s Bridge Tavern. He said they were part of keg swaps, and the officer found that swaps took place and were not prohibited by company procedures. The company maintained that dismissal was reasonable and that Bissett’s explanation lacked credibility.
The officer found the company had not proved the dismissal was fair, preferring Bissett’s direct evidence. The officer also found dismissal was outside the range of reasonable responses and was not proportionate. Compensation was limited to four weeks’ pay because Bissett did not accrue losses while medically unfit for work and did not seek full-time work after returning part-time. His separate Payment of Wages complaint was withdrawn.
