The Workplace Relations Commission dismissed Olumide Smith’s Equal Status complaint against Peter Tyndall, finding it frivolous or vexatious. The decision was dated 27 September 2022. Smith alleged race discrimination, victimisation and harassment after receiving a notice of denial of service following an email, and said Tyndall subjected him to threatening and offensive acts during Circuit Court proceedings. Tyndall said correspondence had been sent by post and email, and he could not be responsible for postal handling. The adjudication officer said a complainant must have sought goods or a service available to the public and establish discrimination on a stated ground. The officer found Smith had not sought goods or services from Tyndall by emailing him or during the court hearing, and dismissed the claim under section 22. The merits of the alleged discrimination, victimisation and harassment were not decided.
