The Labour Court varied an adjudication officer’s decision and awarded Rhys Acton €150 after finding Dublin Bus breached rules on notice of working hours. The decision was dated 26 September 2022. SIPTU appealed on Acton’s behalf, arguing that he was notified of his shift during scheduled rest days. Dublin Bus said spare drivers’ shifts were harder to predict, accepted a technical breach of section 17(3), and said it had changed its notification procedures. Acton received notice at 9pm on 22 April 2018 for a shift starting at 7.05am on 24 April. The Court found no breach of section 17(1), but found the notice failed to meet section 17(3)’s timeframe. It considered the breach minor because Acton had more than 24 hours’ notice, suffered no material adverse consequences, and Dublin Bus had amended its procedures.
