The Workplace Relations Commission found Martin Browne’s unfair dismissal and notice-pay complaints against Egis Road & Tunnel Operation Ireland Limited were not well founded. The decision was dated 6 October 2022. Browne, a duty manager in the Dublin Port Tunnel control room, said he was unaware of a prank that sent a patroller racing towards a falsely reported crash. The WRC found he heard the incident and failed to intervene, putting tunnel users and staff at risk, and concluded dismissal was reasonable. It considered the process overall fair despite not giving Browne the chance to cross-examine colleagues during the investigation. His notice-pay complaint also failed because the WRC found dismissal for gross misconduct did not entitle him to notice.
