The Workplace Relations Commission found a retail assistant’s dismissal unfair and awarded her €7,500. Adjudication officer Pat Brady dated the decision 26 April 2018. The visitor facility said it dismissed her for gross misconduct after four till discrepancies totalling €220. She said the errors were accidental and the employer had not properly considered her explanation. The WRC found that dishonesty and gross misconduct were not put to her before dismissal, and that there was no evidence to support the suggestion she deliberately concealed transactions. It also found the dismissal disproportionate. The adjudicator took account of her efforts to mitigate her losses when setting the award.
