The Workplace Relations Commission found that a public employer did not discriminate against an employee on gender or age grounds in promotion. The decision was dated 17 May 2017.
The employee said men and older workers were disadvantaged in promotion and relied on statistics combining competitions held between 2009 and 2015. The employer said its recruitment system had been audited and that promotions were based on merit. The adjudication officer extended the time limit to hear the complaints but said only the 2015 competition could be investigated.
The officer rejected the combined statistics because each promotion competition was an independent event and the results needed to be analysed separately. The other evidence did not establish that the employer discriminated on either ground. Both complaints failed on their merits.
