WRC finds employee’s dismissal fair after gross misconduct findings

By Tadhg O'Sullivan

Workplace Relations Commission ·

The WRC found an employee’s dismissal fair and rejected her unfair dismissal complaint against an employer. Adjudication Officer John Tierney dated the decision 27 April 2017. The employer said two gross misconduct findings meant it could not continue employing her and that it had followed fair procedures. She argued that it should have recognised her erratic behaviour and considered occupational health input. The WRC said the employer had tried to understand what was happening, but she did not allow her union or solicitor to explain her situation to management. It found the employer had acted fairly and proportionately, and the complaint failed.
