The Workplace Relations Commission found a bar manager’s constructive dismissal complaint against A Nightclub not well founded in a decision dated 20 March 2017. He resigned after being demoted from a weekly salary of €700 to an hourly rate of €14 following an investigation into personal internet use at work. The manager said the demotion and pay change were disproportionate and the disciplinary process unfair. A Nightclub said he resigned before using its grievance procedure and that the demotion was temporary, with a possible return to management after six months. The adjudication officer criticised the investigation for making disciplinary findings before a separate disciplinary stage and said the evidence did not establish that the manager was not doing work while browsing. But the officer found that the employer had offered a route back to management, guaranteed 45 hours a week and proposed training and mediation. The manager had not shown that the employer’s conduct entitled him to treat the contract as ended or made resignation reasonable.
