The Workplace Relations Commission found a general operative’s dismissal unfair on procedural grounds and awarded him €4,500, equivalent to 13 weeks’ pay. The decision was dated 23 November 2016. The adjudicator found the worker started the workplace altercation and that the company had sufficient grounds to dismiss him. But the investigation and appeal were procedurally unfair: he was not given advance written notice of the allegations and possible outcome, a witness was not interviewed, and nearby cameras were not checked. The adjudicator found that the worker contributed significantly to his dismissal, which was reflected in the award.
