WRC awards €42,900 after finding mobile phone retailer unfairly dismissed sales consultant

Workplace Relations Commission ·

The Workplace Relations Commission has awarded €42,900 to a senior sales consultant after finding that a mobile phone retailer unfairly dismissed him. Adjudication Officer Kevin Baneham dated the decision 7 February 2017.

The retailer said the dismissal followed breaches of its “family and friends” offer policy and that the consultant could not account for some handsets. He said customers received the phones and his manager had approved his own nominations.

The WRC found that the retailer did not establish what happened to the handsets or interview the consultant’s manager and colleagues, whose evidence could have tested his account. It also found that the retailer did not follow up on evidence offered during the appeal. The WRC found the dismissal unfair and awarded €42,900 for financial loss.
