The Labour Court left unchanged a Rights Commissioner’s recommendation in a dispute over a catering worker’s service date at Aer Lingus. The decision was dated 20 April 1998. The Services Industrial Professional Technical Union argued that the worker’s earlier temporary service should count and that she was on sick leave when an agreement set her service date. Aer Lingus said the agreement covered her circumstances and other workers. The Court did not change the recommendation because an agreement covered the transfer to permanent employment and affected other workers. It recommended that the parties agree a formula for recognising past service in future transfers to permanent work.
