In 1997, the Labour Court rejected the Marine, Port and General Workers’ Union’s appeal for a pay premium for a full-time forklift driver at Elida Lever Limited’s Tallaght warehouse. The decision was signed on 27 June 1997. The union said the worker was the warehouse’s only full-time forklift driver and that colleagues in other full-time roles received differentials. The company said forklift driving was included in the operative grade’s agreed rate and that it had not intended to employ a dedicated forklift driver. The Court found the Rights Commissioner’s recommendation against the claim was not unreasonable and upheld it.
