In 1996, the Labour Court rejected an appeal by the Services Industrial Professional Technical Union over compensation for a worker at Cadbury (Ireland) Limited. The decision was dated 27 May 1996. The worker had moved from transport to production before the company contracted out its distribution operation.
The worker sought the compensation arrangements offered to transport staff relocated into the factory in July 1995. The union argued that he had worked as a driver for 12 years and would likely have obtained a driving job if those jobs had not been contracted out. Cadbury said the arrangements applied only to staff then working in transport, who returned to the factory for organisational reasons.
The Labour Court upheld the Rights Commissioner’s recommendation that the claim should fail and rejected the union’s appeal.
