In 1995, the Labour Court rejected the Services Industrial Professional Technical Union’s appeal and upheld the Rights Commissioner’s recommendation that a worker’s forklift allowance claim fail. The decision was dated 22 February 1995. Harris Calorific Limited said the Grade F rate included forklift duties when the worker took the position in 1991. The union argued the allowance had not been discussed and sought its restoration. The Court found the Grade F offer included the duties and recommended that the parties review their agreement to address anomalies arising from changes to grading structures.
