In 1993, the Labour Court rejected Shamrock Lodge's appeal and upheld a Rights Commissioner's recommendation that the employer reimburse Mr Gilligan £439.20 for holiday cancellation costs. The decision was dated 27 April 1993. Mr Gilligan said he had arranged to take holidays from 30 August but was later told to take them on 25 July, incurring a cancellation cost. The union, the Irish National Union of Vintners', Grocers' and Allied Trades' Assistants, said he had received only six hours' notice. Shamrock Lodge said it had notified him on 1 July and cited planned renovation work.
