In 1992, the Labour Court upheld a Rights Commissioner’s recommendation that a worker receive £3,750 after finding Campbells Mini-Coaches withdrew a definite job offer. The decision was signed on 7 February 1992.

The worker had been employed seasonally in tourism and hoped to obtain full-time work after completing a F.A.S. course. She applied for a job with the company, accepted its offer and asked for the terms in writing. She then resigned from her temporary position. Campbells Mini-Coaches denied making an offer and said the vacancy had been filled.

The Court found that the company’s letter showed a definite offer was being withdrawn because the worker had requested a letter of appointment. It found she had acted reasonably in resigning in reliance on the offer and had suffered considerable lost earnings. The Rights Commissioner had recommended £3,750 in full and final settlement of claims arising from the company’s failure to honour its employment undertaking. The Labour Court left that recommendation standing.
