In 1992, the Labour Court upheld an appeal by the Amalgamated Transport And General Workers Union, deciding that a worker should have access to Cadbury (Ireland) Limited's 1991 full-time shift option. The decision was signed on 23 January 1992. The worker had chosen weekend work in 1989. After weekend work stopped, the company recruited some weekend workers to full-time jobs but refused to recruit her. A Rights Commissioner had recommended against giving her another option, and the union appealed. The company argued that the worker had already used a once-off option and knew weekend work was not guaranteed to continue. The Court said it was unreasonable and unfair to bind her to her original choice when colleagues with less service had access to a different option.
