In 1992, the Labour Court upheld a Rights Commissioner’s recommendation that a worker accept a new post at St Michael’s House and receive a £500 goodwill payment. The Court signed its decision on 24 January 1992.
The worker had been an Employment Advisor for 15 years. St Michael’s House introduced a Vocational Training Programme that changed her duties and placed her in a team with new reporting arrangements. The Services Industrial Professional Technical Union appealed, seeking an agreed job description and reporting structure.
St Michael’s House said the new structure was needed for the programme and that the worker would keep her salary scale and conditions. The Court found the changed system and increased funding were incompatible with her former semi-autonomous status, but said she could continue successfully as part of the Employment Team. It decided that the Rights Commissioner’s recommendation should stand.
