In 1991, the Labour Court left in place a Rights Commissioner’s recommendation that six former senior cabin crew members were not entitled to retain their senior pay differential after transferring routes. Dated 23 July 1991, the decision followed an appeal by the Services Industrial Professional Technical Union. The Union said earlier transfers showed senior salaries had been retained and argued the transfer agreement was not in place when the six applied. Aer Lingus said applying the agreement to them would extend conditions and could prompt further claims. The Court found no reason to change the recommendation. Aer Lingus had already applied its separate recommendation that the differential be paid to eight crew members covered by the 1990 transfer agreement.
