In 1988, the Labour Court upheld a Rights Commissioner's recommendation that Cantrell And Cochrane (Dublin) Limited offer a permanent distribution job to the stand-by worker with the longest overall company service. The decision was signed on 25 November 1988. The Irish Transport and General Workers' Union and Federated Workers' Union of Ireland supported using company service to choose among six stand-by workers appointed on the same day. The company argued that it should select the most suitable candidate. The Court said the recommendation was fair and reasonable in the specific circumstances and safeguarded the company's right to manage.
