The Labour Court upheld the Amalgamated Transport And General Workers Union (A.T.G.W.U.)'s appeal over a disputed vacancy at Cadbury Ireland Limited. The decision was signed on 19 September 1988. A Rights Commissioner had recommended placing a worker whose stacking job had been eliminated in a packer vacancy on the No. 2 Twirl wrapping machine as an exception to the job agreement. Cadbury Ireland Limited and the Federated Workers' Union of Ireland accepted that recommendation, but the A.T.G.W.U. objected. The Court said any exception had to be acceptable to all concerned and that a party to the agreement could insist on its strict application. It upheld the A.T.G.W.U.'s appeal and said Cadbury Ireland Limited should not implement the earlier recommendation.
