The Labour Court rejected a worker’s appeal against a Rights Commissioner’s recommendation on a car allowance and annual leave. The decision was dated 13 December 2011 and concerned Eircom Limited and a worker represented by the Communications Workers’ Union. The Court found the worker’s contract reflected terms agreed in 2005 for newly appointed Partnership Coordinators, so it found no merit in treating his car allowance as pensionable. Eircom should comply with any clarification on the issue from the Eircom Superannuation Scheme. It also found that linking the Partnership Coordinator role to the Technical Team Leader grade set the rate of pay only; the worker’s annual leave remained in line with his substantive PDTM grade.
