The Labour Court rejected a worker’s appeal over Eircom Limited’s treatment of his car allowance and annual leave, while varying the Rights Commissioner’s recommendation. The decision was signed on 13 December 2011. Represented by the Communications Workers’ Union, the worker argued that he should have the same terms as other Partnership Coordinators. The Court found that the 2005 agreement and the worker’s signed contract supported treating the car allowance as non-pensionable. It said Eircom should comply with any clarification he obtained directly from the Superannuation Scheme. The Court also found that the link between his role and the Technical Team Leader grade applied only to pay; his annual leave remained governed by his substantive CTL grade.
