The Labour Court allowed University College Dublin’s appeal and set aside a Rights Commissioner’s recommendation for compensation after a worker’s return from career break was delayed. The decision was signed on 1 June 2011. The Services Industrial Professional Technical Union argued that the worker should receive pay and increments for the delay. UCD said the agreed terms entitled her to the next available post at her grade, but not pay while a position was being sourced. The Court found that the terms agreed in May 2008 governed her return and that UCD had acted in accordance with them.
