The Labour Court dismissed Michelle Svoboda’s appeal against the rejection of her discrimination, harassment and victimisation complaints against IBM Ireland Product Distribution Limited. The determination was signed on 1 June 2011.
Svoboda alleged abuse, degrading and insulting treatment, disciplinary proceedings and a failure to investigate a bullying or harassment complaint. The Court found the email and performance review interviews she relied on made no reference to the protected grounds. It also found no evidence of harassment or victimisation and upheld the Equality Officer’s decision.
