Labour Court upholds finding against sous chef in Trim Castle Hotel appeal

The Labour Court upheld the Rights Commissioner’s decision and dismissed a worker’s appeal over his departure from Trim Castle Hotel Limited. In a decision signed on 7 February 2008, the Court found he had not made out a case of constructive dismissal. The worker, a sous chef from New Zealand, said accommodation had been promised as part of the job and he had no option but to resign when it was not provided. The hotel denied making that promise and said it had tried to help him find accommodation. The Court found management had not indicated accommodation would be part of his pay package and had acted reasonably. It concluded that he chose to leave without just cause and upheld the finding that the hotel had not breached a contract.
