The Labour Court disallowed Limerick City Council’s appeal and affirmed a Rights Commissioner’s recommendation in a dispute over a worker’s seniority listing and transfer from the Cleansing Department. The decision was signed on 9 December 2008. The Services Industrial Professional Technical Union argued that the worker and colleagues had agreed a seniority list in 1989 and that he should return to the department. The Council said it did not recognise a private list and had transferred him under its 2004 agreement with the union. The Court found that the Council acted reasonably by applying seniority based on length of service.
