The Labour Court disallowed Limerick City Council’s appeal and affirmed a Rights Commissioner’s recommendation against a worker’s claim for a lump-sum payment. The decision was signed on 9 December 2008. The Services Industrial Professional Technical Union said the worker’s 2007 transfer from the Cleansing Section changed his working week and conditions. He sought a payment made to Housing Maintenance Section staff in 2001/2002 for accepting changes to work practices. The Council said the agreement applied only to staff employed in Housing Maintenance when the changes were introduced. The Court agreed that the agreement was confined to those staff and found the union’s claim was not well founded.
