The Labour Court upheld a Rights Commissioner’s recommendation giving a worker credit for full service when calculating annual entitlements and a €3,000 ex-gratia payment. It dismissed the worker’s appeal over seniority and loss of earnings following redundancy at Iarnrod Eireann. The decision was signed on 8 December 2006. The worker was represented by the Services Industrial Professional Technical Union.
The union said the company had failed to acknowledge that the worker applied for vacancies before being made redundant and estimated the earnings loss at €16,741.60, not including possible overtime. The company said it had no record of those applications and that the outstanding issues had been settled in October 2004. The Court upheld the recommendation after considering the parties’ submissions.
