The Labour Court varied a recommendation in Tesco’s appeal, recommending that it pay an unnamed worker €3,000 in full and final settlement of the claims before it. The decision was dated 21 April 2006. The worker, represented by Mandate, had been assigned temporarily to day duties while recovering from an occupational injury. The Court said he retained the right to return to his substantive night shift section manager role after the six-week assignment, while accepting that temporary operational changes could be made. It found he had grounds for concern about his treatment and had suffered needless uncertainty about his position. The €3,000 was additional to money Tesco had already paid.
