Labour Court rejects Fas worker’s bid for Grade 11 promotion

The Labour Court affirmed a Rights Commissioner’s recommendation against upgrading an unnamed Fas worker to Grade 11. The decision was dated 19 April 2006. The union argued the worker performed the same duties as a Grade 11 employee. Fas said he had not been instructed to work above his grade and that promotions required an approved vacancy and competition. The Court said there was no basis to recommend the upgrade, but recommended that any instructed work above his grade be recorded and paid accordingly.
