The Labour Court upheld a Rights Commissioner’s recommendation that South Monaghan Cleaning Services Ltd pay a worker €1,200 over an alleged unfair dismissal. The Court’s decision was dated 26 November 2004. The worker was dismissed while on probation after an investigation found an arrangement with several employees to falsify clock cards. He argued that he was the only employee dismissed over the issue and said he had not known an investigation was under way. The company said he had interfered with clock cards and was unsuitable under the probation clause. The worker appealed the Rights Commissioner’s recommendation. The Labour Court said the recommendation was correct and upheld it. It had taken account of the worker’s contribution to the employer’s decision when recommending the payment.
