The Labour Court upheld the Rights Commissioner’s recommendation in a worker’s claim against Gary Cunningham T/A Frencon Ltd after the employer failed to attend the rescheduled appeal hearing. The decision was signed on 26 August 2004. The worker, a carpenter, had claimed arrears of wages, travel time and notice pay. The employer had also failed to attend the Rights Commissioner hearing, where the Commissioner advised it to pay the amount claimed. The Labour Court said the employer was not present to move its appeal.
