Equality Officer Gerardine Coyle found that Intel Ireland Limited did not discriminate against Ultan Sinclair, harass him, deny him reasonable accommodation or victimise him. In a decision dated 26 August 2004, Coyle recommended that the company make its promotion procedures more open and transparent.
Sinclair alleged discrimination on six grounds in performance ratings and appointments, as well as harassment, failures to provide reasonable accommodation and victimisation. Intel denied the claims. Coyle found no evidence that Sinclair’s disability affected his performance rating or that the appointments were discriminatory. She also rejected the harassment, accommodation and victimisation allegations.
However, Coyle found that the process for technician development positions and access to the Supervisor Grooming Programme was not open and transparent, leaving Intel exposed to allegations of favouritism and discrimination. She recommended advertising vacancies, assessing applicants against defined criteria, interviewing candidates and keeping interview records.
