In 2003, the Labour Court rejected a worker’s appeal against a written warning issued by Cadbury Ireland Limited after a complaint about a manager’s conduct. The Court upheld the Rights Commissioner’s recommendation in a decision signed on 9 December 2003. The worker said the manager put a hand on him and tore up a newspaper. Cadbury said its investigation found the worker’s allegation of assault unfounded. The Court said the company could act under its agreed procedure, which allowed disciplinary action when a complaint was found unfounded. It also recommended changing the procedure so disciplinary action could follow a complaint found to be “malicious or vexatious” rather than merely “unfounded”. The worker was represented by the Amalgamated Transport and General Workers' Union.
