Supreme Court refuses Walshe permission to appeal referendum challenge

By Ruairí Dolan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Supreme Court refused Gerry Walshe permission to appeal the Court of Appeal’s dismissal of his attempt to bring a petition challenging the marriage referendum result. The Court found he had not raised a point of general public importance or a point of substance warranting an appeal, and that the interests of justice did not require one.

The Court of Appeal had dismissed Walshe’s application on July 30, 2015, finding no basis to grant leave for a petition. It also lifted the stay that had prevented issue of the final referendum certificate. The Supreme Court noted that no stay had been sought after the Court of Appeal ruling, and the certificate was subsequently issued.
