Seaconview Designated Activity Company won a summary judgment application against John Lally in the High Court on 20 July 2017 over a guarantee for loan interest. Lally, a property developer based in County Galway, had guaranteed interest obligations connected to an €82.5m credit facility for the acquisition of Dublin properties.
Mr Justice Max Barrett granted Seaconview summary judgment on its claim for just short of €9m plus interest. The court accepted that Seaconview had succeeded to the relevant rights and could enforce the guarantee.
Lally had challenged Seaconview’s entitlement to demand payment, the validity of the transfer certificate and discrepancies in the demand letter. The court held that he virtually had no case.
