Midnight Entertainment wins recusal challenge over liquor charge
This report is a localnews.ie summary based on public court reporting and records; sources are listed below.
Midnight Entertainment Limited won its High Court challenge over a liquor-licensing prosecution on 28 March 2019, when relief was granted against a District Judge’s refusal to recuse herself. The company, trading as Four Aces Casino in Galway, was prosecuted for selling or exposing alcohol for sale without a licence.
The High Court held that a reasonable person might view the case as involving effectively the same party facing the same charges before the judge after an earlier conviction against a company director had been overturned on appeal. The court therefore quashed the refusal to recuse and granted the relief sought.
