A Dublin-based Garda secured a Norwich Pharmacal data-disclosure order at the High Court on 28 March 2019 over an allegedly defamatory YouTube video. Following talks, Google consented to disclose the information it holds about the identity of the person who posted it. The case came before Mr Justice Senan Allen.
The Garda, who cannot be identified for legal reasons, claimed the video commentary wrongly accused him of kicking a minor in the head during a 2016 public-order incident. He also claimed the audio did not match or reflect the images shown.
The injunction proceedings against Google were discontinued and struck out, while the proceedings against the poster continued. The parties agreed that each side would pay its own costs.
