Michael Flatley’s High Court claim over alleged damage to Castlehyde was adjourned for one week after a Commercial Court hearing on 22 January 2024.

Flatley claims unsafe chloride residue from PVC combustion during a 2016 fire contaminated the Co Cork property. Austin Newport Group Ltd denies the claims, and all allegations are denied.

A construction costs consultant provisionally estimated repairs at €30 million. A surveyor’s report supporting Flatley’s claim identified alleged residue in areas including the pool, spa and cinema. The earlier repair estimate had been €25 million.

The proceedings concern Flatley’s claims against the contractor and insurance underwriters, as well as David Cushion, whom he has sued over alleged negligent misstatement and breach of contract. The court was told the proceedings had not been properly served on Cushion.

Cushion’s counsel, Neil Steen SC, said his client was adamant that he had no responsibility for the alleged issues and could not understand why he had been named personally, as he had always been a partner of MSE Business Management LLP. Steen said he would bring a motion to dismiss the case against Cushion for failing to disclose a cause of action.
