Meenbog Wind Farm appeal over planning breaches dismissed

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Court of Appeal dismissed Planree Limited and Mid-Cork Electrical Limited’s appeal over planning breaches at Meenbog Wind Farm on 18 December 2024.

The appeal concerned a Donegal County Council order stopping further development at the wind farm in County Donegal. The companies argued they should be allowed to complete authorised elements while a substitute consent application was pending.

The court held that material deviations from planning permission generally made the entire development unauthorised. It found this case did not qualify for the exceptional possibility of treating unauthorised works as severable, and dismissed the appeal on all grounds.

The court also upheld the High Court order. It declined to comment on the substitute consent application, which was pending before An Bord Pleanála.
