Mary and Michael Daly can include legal fees in insolvency plans

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The High Court dismissed Mae Rae’s appeal on 23 January 2023, allowing €77,000 in legal fees awarded against Mary and Michael Daly to be included in their proposed Personal Insolvency Arrangements. The fees arose from a 2018 High Court case over a 2012 dog attack in Co Cork.

The court said the legal fees could be included as a debt in Mr Daly’s proposed arrangement. The €179,000 damages award to Rae was not included; debts due from court-awarded personal injury damages are excluded from Personal Insolvency Arrangements under the 2012 Act.

The Circuit Court was to consider approval of the couple’s arrangements at a later date.
