Joseph Behan’s conviction for shooting two restaurant workers was upheld by the Court of Appeal, in a ruling reported on 16 July 2021. The shootings happened at Mizzoni’s Pizza in Raheny, Dublin, on 1 January 2019.
Behan had been convicted by a jury of robbery, attempted robbery, assaults, firearm possession and reckless discharge of a firearm. He was sentenced to 15 years in prison for assault causing harm by Judge Martin Nolan at Dublin Circuit Criminal Court.
Behan appealed, arguing that a search warrant for his home was invalid and that firearms residue evidence from a glove found there should have been excluded. The Court of Appeal rejected the challenge and dismissed his appeal.
