James McDonagh was sentenced at Dublin Circuit Criminal Court to four years in prison, with the final two years suspended, for threatening to kill or cause serious harm to his neighbours Dolores and Patrick Doyle.

McDonagh pleaded guilty to the threats. The offences took place on 20 September 2015. The proceedings were reported on 25 June 2018.

The court heard that Dolores Doyle had found damaged bunting she had put up to support Dublin in the All Ireland. She and her husband had twice asked McDonagh’s children to stop coming into their garden and pulling it down. Garda Garret Durnan said McDonagh became aggressive after she asked the children about the damage.

The garda said McDonagh left but returned with what the couple described as a handgun. He pointed it at Dolores Doyle’s head and then at Patrick Doyle’s face. Both feared they would be shot. The gun was never recovered.

Judge Martin Nolan said the gun was probably not real and that he did not think McDonagh had intended to harm the Doyles. He said it was convincing and they felt their lives were under threat. The judge accepted that McDonagh had taken concrete steps towards rehabilitation but said a custodial sentence was necessary.

Victim impact reports described Dolores Doyle looking over her shoulder and avoiding local socialising. Patrick Doyle, who had recently suffered a stroke, sought medical treatment and experienced anxiety in the immediate aftermath. Garda Durnan agreed with defence counsel Carol Doherty that McDonagh’s guilty plea and move from the area had alleviated any future concerns the couple might have had.

Ms Doherty said McDonagh was deeply remorseful and had started alcohol treatment. She said he had moved his family out of the area to avoid causing the Doyles further difficulties.
