The High Court was told on 17 July 2023 that Wojciech Bialek had complied with an order to vacate the Cork offices of Together-Razem Centre Company Limited by Guarantee. The charity’s lawyers also said it had yet to regain possession of the offices.
The charity had obtained the injunction late the previous week. It restrained Mr Bialek and others aware of the order from removing, deleting or copying its documents at Kilnap Business Park, Old Mallow Road, Blackpool. It also restrained him from transferring or withdrawing its funds, entering or attending its property, and representing himself as its employee, trustee or chairperson.
The charity alleged that Mr Bialek and others had unlawfully attempted to replace its directors. It claimed an extraordinary general meeting called the previous month had passed a resolution replacing the directors and company secretary, but that the meeting and vote were invalid. It also alleged that Mr Bialek subsequently presented himself as chairperson and seized control of the offices by changing the locks. The claims of wrongdoing were denied.
The charity claimed Mr Bialek had stood down after an independent accountant sought clarification about transactions. His lawyers said they needed time to respond fully to the allegations.
Mr Justice Brian O’Moore set a timetable for exchanging documents and adjourned the case until later in July. He declined at that stage to order a meeting to select board members, but said Mr Bialek could bring a motion seeking such an order when the case returned.
