Enoch Burke ordered to pay school’s High Court legal costs

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Enoch Burke was ordered to pay Wilson’s Hospital School’s legal costs at the High Court on 17 July 2023, after the school succeeded in its action over his suspension and trespass at its Multyfarnham, Co Westmeath premises.

Mr Justice Alexander Owens also restrained Burke from trespassing on the school premises, while allowing him to attend outside the gates. The costs order followed his May ruling that Burke’s suspension was lawful and that the school was entitled to a permanent injunction and €15,000 in trespass damages.

The school’s action concerned its decision to place Burke on paid administrative leave pending disciplinary proceedings. The school alleged gross misconduct; Burke denied wrongdoing and argued that the process and suspension breached his rights.
