Ezeon Entertainment Limited asked the High Court to hear its challenge to John O’Driscoll’s personal insolvency arrangement, at a hearing on 16 January 2023.
Mr Justice Alexander Owens said the jurisdiction issue had to be decided first and adjourned the matter for a week so the parties could exchange documents. He said he intended to set a hearing date for that preliminary issue when the application returned the following Monday.
The Circuit Court granted Mr O’Driscoll the arrangement in March 2022, and the High Court upheld it on appeal in July 2022. Ezeon’s application to set it aside remained unresolved at the January hearing.
Ezeon alleges that Mr O’Driscoll misappropriated company funds and that the arrangement did not properly identify his debt to the company. Mr O’Driscoll denies wrongdoing and says the withdrawn money repaid amounts he was owed.
